Rate Services Terms and Conditions

This
agreement sets out the terms and conditions that we have agreed in order for
you to promote National Rate Services (0870/0871 numbers) in return for
financial remuneration. The term “4FREE” mentioned in this agreement refers
to us and the term “client” refers to you the applicant.

Nothing in
the agreement shall create, or be deemed to create, a partnership, joint
venture or the relationship of employer and employee or except to the extent
set out in this agreement. The Client also understands that any legal
responsibilities including but not limited to Income Tax, VAT and National
Insurance etc. is the Client’s responsibility.

4FREE agree
to pay the client the current pence per minute rate per number as designated
on the 4freeTELE.COM
Internet site. These rates are subject to changing market conditions, and it
is the client’s responsibility to make themselves aware as to the current
rates.

0871 numbers
and 0871 voicemail numbers
are subject to a refundable connection charge of £10.00 + VAT. The connection
charge will be refunded when the traffic on the line exceeds £250.00 per
month.

0871 Voicemail numbers are
free to schools and registered charities.

If the Client chooses to divert his or her 0870
number to a mobile then a one-off connection fee of £19.99 + VAT is
chargeable. Further, the client shall pay the divert
costs of 15p per minute for all incoming calls. Should the Client wish
to transfer their
0870 number to a landline at a later stage, then this will done free of
charge. In the event that the Client wishes to transfer back to a mobile
again, then a connection charge of £9.99 + VAT shall apply.

There is a one off set up fee of £29.99
+ VAT for the 0870 Time Plan Option. Two alterations to this plan are included per year.
Further changes will be charged at £9.99 + VAT per time.

There is a one off set up fee of £49.99
+ VAT for the 0870 Geographic Routing Option. Two additions or
deletions to this plan are included per year.
Further changes will be charged at £9.99 + VAT per time.

Payment shall
be made approximately 50 days from the end of your first month. This is to
allow us to collect all monies due from the suppliers and Telco's and
to provide a period to prevent claw back. After the first payment you will be
paid monthly. No cheque is issued for under £25. If the amount due is less
than £25 this will be automatically rolled over until your total earnings
exceed £25.

4FREE cannot
be held responsible for any losses or liability however caused should the
service(s) be suspended or breakdown etc. Neither can 4FREE be held
responsible for any loss of earnings however caused whether direct, indirect
or consequential.

4FREE will
agree to change your
landline
target number for the first three diversions free
of charge. If you require more changes we charge an annual fee of £25.00 + VAT
for unlimited diversions.

All set up
fees etc. are non refundable.

4Free remain the leaseholders on all allocated numbers and any porting arrangements must be agreed in writing with 4FREE at its sole discretion. 4Free abide by Ofcom the independent regulator and competition authority for the UK communications industries, with responsibilities across television, radio, telecommunications and wireless communications services.

4FREE shall
have the right to terminate a Client’s contract and service and retract the
national rate number should the Client fail to promote the Service and
generate any revenue. This shall be at the sole discretion of 4FREE after
consultation with the client.
However, we never, ever,
disconnect a number without contacting the Client nor do we in any way want to
disconnect a number for the sake of it. This clause is only ever invoked
in the case of a business closure or when we are unable to contact the Client
over a prolonged period.

4FREE
reserves the right to change these Terms and Conditions without notice with
the new additions and/or deletions made readily available on the Internet site
and that these new Terms and Conditions shall override the old.

The Client
agrees that any monies owing to 4FREE shall be deducted from any income before
payment.

The Client
can terminate a Service by giving 30 days notice in writing. This can be by
email but a receipt should be asked for.

The agreement
shall be governed by and construed in accordance with the Laws of England.

The Client
must be 18 years of age, or over, to order an 087x
number.
